("Aptivist," "we," "us," or "our"), with registered address at World Trade Center, Montecito 38, Piso 28, Oficina 16, Colonia Nápoles, Alcaldía Benito Juárez, C.P. 03810, Ciudad de México, México, is responsible for the collection, use and protection of your personal data in accordance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP) and its Regulations.

2. Personal Data We Collect

We collect the following personal data directly from you when you voluntarily complete our contact form or communicate with us:

  • Full name
  • Company name
  • Work email address
  • Project type and description
  • Any additional information you choose to provide in your message

We do not collect sensitive personal data (datos personales sensibles) as defined under the LFPDPPP, such as racial or ethnic origin, health, biometric, financial, political, religious or union-related data.

3. Purposes of Processing

Primary purposes — necessary to fulfill your request and which we cannot limit without affecting our ability to respond to you:

  • Responding to your inquiry or request for information
  • Contacting you to discuss a potential software development engagement
  • Evaluating the feasibility of a business relationship
  • Managing and following up on the business relationship, if established

Secondary purposes — not strictly necessary, but which we may use if you do not object:

  • Sending commercial communications about our services, news or events

To opt out of secondary purposes, send an email to contact@aptivist.com with the subject line "Opt Out – Commercial Communications" at any time, including at the moment you provide your data.

4. Transfer of Personal Data

We do not sell, rent or transfer your personal data to third parties for their own commercial use without your express consent.

We may share your data with trusted service providers that support our internal operations — such as email hosting, CRM platforms, and cloud infrastructure providers — solely for the purposes described in this notice and under data processing agreements that impose equivalent or stronger data protection obligations.

We may also disclose personal data when required by law, court order or competent authority, in which case we will inform you to the extent permitted by law.

5. Your ARCO Rights

Under the LFPDPPP, you have the right to:

  • Access — know what personal data we hold about you and how we use it
  • Rectification — request correction of inaccurate, incomplete or outdated data
  • Cancellation — request deletion of your personal data when it is no longer necessary for the purposes for which it was collected, subject to applicable legal retention obligations
  • Opposition — object to the processing of your personal data for specific purposes, including secondary purposes

You also have the right to revoke consent you have previously granted, where processing is based on your consent, to the extent permitted by law.

6. How to Exercise Your ARCO Rights

Submit your request by email to contact@aptivist.com with the subject line "ARCO Rights Request", including:

  • Your full name
  • A copy of a valid government-issued photo ID
  • A clear description of the right you wish to exercise and the personal data concerned
  • Any additional information that may help us locate and process your request

We will acknowledge your request within 5 business days and respond fully within 20 business days of receiving a complete and valid request, as required by the LFPDPPP. This period may be extended by an additional 20 business days in complex cases, with prior notice.

If you are not satisfied with our response, you may file a complaint with the Instituto Nacional de Transparencia, Acceso a la Información y Protección de Datos Personales (INAI) at home.inai.org.mx.

7. Data Retention

We retain your personal data only for as long as necessary to fulfill the purposes described in this notice, or as required or permitted by applicable law. Once data is no longer needed, it will be securely deleted, anonymized or blocked.

Where a business relationship is established, we may retain relevant data for up to 5 years after the conclusion of that relationship to comply with legal, tax and audit obligations.

8. Cookies and Tracking Technologies

Our website does not currently use analytics, advertising or profiling cookies, nor third-party tracking pixels. We only use technical cookies strictly necessary for the site to function correctly.

If we introduce additional cookies or tracking technologies in the future, we will update this notice and, where required by law, request your prior consent through an appropriate mechanism displayed on the site.

9. Security Measures

We have implemented administrative, technical and physical security measures appropriate to the sensitivity of the personal data we process, aimed at protecting it against unauthorized access, loss, misuse, alteration or destruction. Only authorized personnel with a legitimate need have access to your personal data.

We may update this Privacy Policy at any time to reflect changes in our practices, legal obligations or applicable regulation. Changes will be published on this page with an updated "Last updated" date. We encourage you to review this page periodically.

Material changes that significantly affect how we process your personal data will be communicated to you directly if we hold a valid email address for you.
